In January 2026, the Hemp Planting Predictability Act was introduced in Congress with bipartisan support.
If passed, it would push the effective date of Section 781 from November 2026 to November 2028 — giving the industry two additional years to establish sensible regulations. The Senate companion bill is supported by Senators Paul, Klobuchar, and Merkley.
✅ TRUMP EXECUTIVE ORDER
President Trump signed an executive order directing his administration to work with Congress to update the definition of hemp to ensure Americans retain access to appropriate full-spectrum CBD products.
While this does not change the law — only Congress can do that — it signals meaningful political support at the highest level.
✅ GOOD NEWS FOR OUR SPRAY

Why the Full Spectrum CBD Ban Threatens Your Products
The problem comes down to one tiny number: 0.4 mg.
For years, hemp products were legal nationwide if they contained less than 0.3% THC by dry weight. This standard allowed Full Spectrum CBD to exist – a product that keeps trace amounts of THC and other natural compounds to give you the powerful “Entourage Effect.“

- The New Rule: The new provision bans products containing more than 0.4 milligrams of Total THC per container (not per serving).

The Political Fight: Who is Trying to Ban Your Full Spectrum CBD?
This fight is happening right now between two powerful figures from Kentucky. It’s a classic battle between those who want to control your choices and those who want to defend your freedom.
- The Rule’s Architect: Senator Mitch McConnell (R-KY). Senator McConnell pushed this change into the bill. While his stated goal was to stop intoxicating products like Delta-8, the overly broad language he used sweeps up and bans the safe, therapeutic Full Spectrum CBD that thousands rely on.
- The Wellness Defender: Senator Rand Paul (R-KY). Senator Rand Paul recognized the severe harm this law would cause. He fought hard in the Senate, arguing that the 0.4mg limit is completely unscientific and would destroy the legitimate hemp industry.
Senator Paul strongly opposed the provision, calling it “the most thoughtless, ignorant proposal to an industry that I’ve seen in a long, long time“. He argues the 0.4 milligram limit is so low that it would outlaw nearly all hemp products, including non-intoxicating CBD, and would devastate the $25–30 billion industry and 350,000 jobs. Paul has also criticized McConnell for pushing the measure without consulting Kentucky farmers, calling it a “vanity project.”

What International Law Says About the Full Spectrum CBD Ban
Most of the debate around this ban has focused on domestic politics, and rightly so. But there is another dimension that deserves equal attention. Under international law, the full spectrum CBD ban was never supposed to happen.
The World Health Organization’s Expert Committee on Drug Dependence conducted a comprehensive scientific review of CBD in 2018 and concluded that CBD exhibits no abuse or dependence potential and is generally well tolerated with a good safety profile. Based on that finding, the WHO recommended that preparations containing predominantly CBD and not more than trace levels of THC should not be placed under international drug control.
The International Narcotics Control Board, the body responsible for overseeing global drug treaty compliance, reinforced this position with its own clarification that CBD is not included in the international drug convention schedules and therefore is not subject to control. In plain language, the world’s leading drug policy authorities said CBD is not an internationally controlled narcotic.
Section 781 ignores both findings entirely. It treats full spectrum CBD products as if they were dangerous controlled substances, imposing a 0.4mg THC per container limit that eliminates most legitimate hemp wellness products from the market. This directly contradicts the WHO’s scientific assessment and the INCB’s legal interpretation.
There is also a point the ban overlooks completely. A genuinely effective CBD product necessarily contains some THC. Full spectrum extracts preserve the natural cannabinoid profile of the whole plant, and that trace THC is what enables the entourage effect — the synergy between cannabinoids that makes whole flower products so much more effective than isolates. For decades, governments cited international treaty obligations as justification for restricting CBD access. That argument no longer holds.
